Who Can Qualify For An EB-5 Visa?

To qualify for an EB-5 Visa, the applicant must:

  • Invest in a new commercial enterprise: Investor immigrants must invest at least $500,000 in a new commercial enterprise in a targeted employment area (TEA) or $1 million dollars in a new business located elsewhere. Applicants may be able to invest in an existing business if their investment caused the business to reorganize, which then allowed the company to get new commercial results, or if their investment increased the net worth of the business or number of employees by 40 percent. TEA investments are generally in rural areas or areas that have a high unemployment rate.
  • Meet the job creation requirements: An immigrant’s investment must create at least 10 new full-time jobs for U.S. workers. These jobs must be created within two years of the investor receiving their visa. This job creation requirement is relaxed if the visa applicant invests in a business in a regional center. Regional centers are designated public and private economic units that are involved in promoting growth. Investments in a regional center only require the applicant to show that their investment either directly or indirectly caused the creation of 10 or more full-time jobs in the region.
