Who Can Obtain Green Cards?

To qualify for a green card, you must meet specific criteria, such as being:

  • A close relative of a citizen: Immediate family members, such as a spouse, unmarried child under the age of 21 or parent of a U.S. citizen can apply for a green card if their relative sponsors their entry.
  • Extended family members of citizens and permanent residents: Siblings, adult children and married children who are related to a citizen or permanent resident of the U.S. may be eligible for a green card. There are many restrictions on who qualifies for this type of green card. Because of these restrictions, it is important to reach out to an immigration attorney to learn if you are eligible.
  • Skilled workers and investor immigrants: Exceptionally skilled and educated workers may qualify for a green card. Investors who wish to invest a significant sum of money into a U.S. business with at least 10 employees may also qualify for a green card.
  • Diversity lottery recipient: The U.S. offers green cards to 50,000 to immigrants from the countries that have had the lowest immigration rates to the U.S.
  • Asylum or refuge qualifier: Asylum-based green cards may be offered to immigrants who currently live in the U.S. and are unable to return to their native country because of a fear of violence or persecution. Refuge is offered to people who live outside of the U.S. but want to come to the U.S. because of violence or persecution.
  • Long-time resident: Immigrants who have lived in the U.S. for more than 10 years can request to receive permanent residency. This type of request often occurs during a deportation or removal case. The immigrant must show that they would face “extraordinary or unusual hardship” if they were deported.
  • Registry qualifier: Immigrants who have continuously lived in the U.S. since Jan. 1, 1972, can apply to get a green card. These immigrants must not have any past criminal issues or other legal problems that would prevent them from staying in the U.S.

A green card offers permanent residents many benefits, including the ability to:

  • Stay in the U.S. permanently
  • Sponsor other family members to immigrate to the U.S.
  • Travel outside of the U.S. and return legally
  • Receive government aid after a waiting period

  • Work most jobs in the U.S. without an added visa
